Data protection laws and regulations are most stringent in the European Economic Area (EEA), but are constantly being revised and updated world-wide.
In the UK the data protection directive has been implemented and the majority of the provisions of the DPA (Data Protection Act) came into force on 1-5-2000. The DPA applies to data controllers who are either established in the UK and data is processed in the context of that establishment or the data controller is established outside the EEA but uses equipment in the UK for processing personal data other than for transit purposes. The DPA only applies to natural individuals who are identifiable from the data or other information which is, or is likely to come into the possession of the data controller.
Personal data may not be processed by a data controller (unless exempt) that has not submitted notification to the Information Commissioner. Although no approval is required, notification must be submitted prior to the first processing of personal data.
The exemptions apply in respect of staff administration, advertising and marketing of the data controller’s business, accounts and records of the data controller or its customer/supplier and certain processing relating to non-profit making organisations.
Whilst the DPA permits data transfers within the EEA, the DPA prohibits transfers outside the EEA unless the destination ensures adequate levels of protection, assessed by the data controller.
